I, the undersigned, in consideration of being allowed to participate in the tour offered by Boobook Explore (hereinafter referred to as "the Company"), acknowledge, appreciate, and agree that:
ASSUMPTION OF RISK:
The Company’s tour activities may vary depending on the tour. Activities include, however are not limited to, trekking through wilderness and remote areas during the day and night; encounters with fauna/flora and the landscape of the natural environment; physical activities such hiking and bushwalking on various terrain including uneven, rocky and shaley areas with loose stone; camping; swimming in creeks; canoeing, preparing and consuming camp-based cooking; exploring land use operations in the region (including working cattle / farming properties and operating gas fields), passengering in four-wheel driving vehicles and participation in outdoor team building activities. Many tours occur in remote areas and may be subject to acts of God such as flood and wildfire.
I acknowledge that during the Company’s tours I may be exposed to natural and man-made hazards and associated risks that may result in, but not be limited to, physical injury, illness, and/or damage to property. I am voluntarily participating in this tour with knowledge of the risks involved and I agree to accept and assume any and all risks and their consequences.
MEDICAL FITNESS AND INSURANCE:
I certify that I am medically fit (including physically and mentally) to participate in the Company’s Tour activities. I understand that the Company does not provide medical and travel insurance and that I am responsible for obtaining my own appropriate medical and travel insurance coverage.
COMPLIANCE WITH RULES AND INSTRUCTIONS:
I acknowledge the Company and its officers, employees and volunteers will take reasonable precautions to ensure my safety and well-being while I am participating in the Company’s tour activities. I agree to follow all rules, regulations, and instructions provided by the Company and its representatives. I understand that failure to comply with these rules and instructions may result in my removal from the tour without refund. In addition, I agree that I will always conduct myself in a responsible manner.
LOST AND STOLEN PROPERTY:
I acknowledge the Company does not accept liability for lost or stolen property and further, that the Company takes no responsibilities for delays caused by weather, vehicle breakdowns, traffic conditions, accidents and/or other conditions beyond its control.
RELEASE OF LIABILITY:
I hereby release, waive, discharge, and hold harmless the Company, its officers, employees, agents, and affiliates from any and all liability, I or any other person suffers or incurs directly or indirectly as a result of my participation in the Tour’s activities, whether that loss or damage is due to my negligence, default, another tort or for any common law or statutory action. I also agree to hold the Company, its officers, employees, agents, and affiliates harmless from and against all liabilities including losses, injuries, sickness, death, legal fees, damages, costs and other expenses in relation to any claims or actions brought against the Company arising out of any breach by me of these terms or any liabilities arising in general.
GOVERNING LAW:
This waiver and release shall be governed by and construed in accordance with the laws of the state/country in which the tour takes place. My signature to this Waiver and Liability Release of my own free will attests to my intent to hold harmless and release from all liability BOOBOOK and any of its past, present or future officers, agents, volunteers or employees to the maximum extent possible under applicable law.
